Every signer must be identified through one of the identification documents or other methods listed in California Code 1185[b]:

  • 1. A California driver’s license or nondriver’s ID issued by the California Department of Motor Vehicle

  • 2. A U.S. passport (or passport card)

  • 3. An inmate identification card issued by the California Department of Corrections and Rehabilitation if the inmate is in prison or any form of inmate identification issued by a sheriff’s department if the inmate is in custody in a local detention facility)

  • 4. A driver’s license or official non-driver’s ID issued by a U.S. state

  • 5. A Canadian or Mexican driver’s license issued by an appropriate public agency

  • 6. A U.S. military ID

  • 7. A valid foreign passport from the applicant’s country of citizenship

  • 8. An employee ID issued by an agency or office of a California city, county, or city and county

  • 9. An identification card issued by a federally-recognized tribal government

  • 10. A valid consular identification document issued by a consulate from the applicant’s country of citizenship that meets specific requirements (To be accepted as proof of identity in California, a consular ID must be current or issued in the past five years, have a serial or identification number, and contain the signature, photograph and description of the individual)

  • 11. The oath or affirmation of one or two credible witnesses

Unacceptable Identification and CANNOT Be Used Under Any Circumstances For Notarization Purpose

  • 1. Badges from Law Enforcement

  • 2. Bank or Credit card

  • 3. Birth or Marriage Certificate

  • 4. Foreign Passport without all of the following: must be current/valid AND a photograph AND description of person named on it AND signature AND identifying number AND U.S. Homeland Security Stamp

  • 5. Insurance card

  • 6. Library card

  • 7. Membership cards (e.g. Costco, Sam's, Fitness )

  • 8. Medicaid/Medicare Card

  • 9. Resident Card (Green Card)

  • 10. Social Security Card

  • 11. Temporary Drivers License  

Two Credible Witness can be used in place of the above identification per California Notary Law, Civil Code, Section 1185(b)(2)

The Two Credible Witnesses:

                

  • Must provide the Notary a Valid ID meeting the above criteria.

  • Under oath the credible witnesses must swear or affirm under penalty of perjury that the following is true:

 

           1.  The individual appearing before the notary public as the signer of the document is the person named in the document

           2.  The credible witness personally knows the signer

           3.  The credible witness reasonably believes that the circumstances of the signer are such that is, would be very difficult

                or impossible for the signer to obtain another form of identification

           4.  The signer does not posses any of the identification documents authorized by law to establish the signer's identity

           5.  The credible witness does not have a financial interest and is not named in the document signed
